The following document sets out the terms and conditions of service for Simply save Energy Ltd. We have set out below the principal terms which come into effect once a customer uses the services of Simply save Energy Ltd.

These terms and conditions govern the use of the services Simply save Energy Ltd provide to customers. It is important that you read these terms and conditions carefully before accepting these terms and conditions. By using the Simply save Energy Ltd services you signify that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree to these terms – DO NOT use our service.

Description of Services

We act as an independent consultant/broker that can give business utilities-related information and advice with the aim of helping customers buy business utilities and/or manage their business utility needs. Whether you have contacted us directly or we have contacted you, you are under no obligation to use our services. However, as a consultant/broker we can support you when getting business utilities quotations from certain UK-based utility suppliers (“Suppliers”, each a “Supplier”). We may also act as a consultant/broker for other business-related services including but now exclusively Water and Telecommunications.

Price Comparison / Switching Service

SIMPLY SAVE ENERGY Ltd provides a price comparison / switching service to UK businesses.

We reserve the right to refuse to provide our services to any customer at our discretion.

If the customer agrees to use our services, SIMPLY SAVE ENERGY Ltd will use its reasonable endeavours to identify, negotiate and secure competitive energy prices. Energy prices are obtained from a panel of energy suppliers using broker price books provided by suppliers..

The customer agrees to provide SIMPLY SAVE ENERGY Ltd with accurate information to allow accurate quotations to be obtained – including estimated or actual usage of energy, contract end dates and other know factors that may influence prices and quotations.

The provision of a quotation by a supplier via SIMPLY SAVE ENERGY Ltd does not constitute an offer to the customer and offers will each have their own supplier’s terms and obligations attached or on the suppliers website.

If the customer accepts a quotation and a contract is executed between the customer and the supplier, the contract is binding, and the customer will not be permitted to revoke such an acceptance.

The supplier shall be entitled at any time to refuse to accept a customer’s offer of acceptance at their discretion.

If the customer and supplier wish to enter into a contract, SIMPLY SAVE ENERGY Ltd will provide a switching service (or renewal service) which will include organizing the contract between the customer and the energy supplier for the purchase and supply of the energy services.

SIMPLY SAVE ENERGY Ltd will not be responsible for any delays or failures caused by either the customer, the proposed supplier or any existing supplier in relation to effecting either a transfer of supply or renewal of supply.

SIMPLY SAVE ENERGY Ltd makes no guarantees as to either the quality of the service suppliers operates, or the prices obtained at quotation.

Energy prices fluctuate on a daily basis and whilst we attempt to help secure competitive rates to enable switching or renewal, we cannot guarantee any quote is the cheapest.

The customer is reminded that ultimately it is their responsibility to validate the accuracy of any quotations presented.

The customer acknowledges that they are entering into a contract with a supplier for the provision of energy supply and not with SIMPLY SAVE ENERGY Ltd. The customer agrees that SIMPLY SAVE ENERGY Ltd is not liable in any way for any dealings, contracts, or transactions between the customer and the supplier and that any such transactions, contracts, dealings, or payment obligations are the customer’s responsibility and risk.

The customer agrees by using the service that SIMPLY SAVE ENERGY Ltd is an independent energy brokerage and that SIMPLY SAVE ENERGY Ltd is not instructed by the customer to act as their agent or representative.

The customer agrees that SIMPLY SAVE ENERGY Ltd is not responsible for the provision of any supplier services.

Charges

In common with all energy supplier comparison websites & energy brokers, Simply Save Energy is remunerated directly by the suppliers and receives a commission for securing and finalizing the contract between the customer and the supplier. The cost of service is therefore included within the cost of the energy contract that you agree with the supplier.

This is usually by way of an uplift that is applied within your unit cost for energy. Our uplifts depend on the size of the contract, length, and other factors such as credit risks.

Because we get paid by suppliers, we only offer prices from those suppliers on our panel. Our panel currently consists of over 90% of the UK business energy suppliers so we have a very wide range to price from.

Limitation of liability

Nothing in these Terms shall limit or exclude our liability for:

  • Death or personal injury caused by our negligence, or the negligence of our employees, agents, or subcontractors.
  • Fraud or fraudulent misrepresentation; or
  • Anything else that cannot be excluded by law.

Subject to the above:

  • We shall under no circumstances whatsoever be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profit (whether direct or indirect) or for any indirect or consequential loss arising under or in connection with our Agreement with you and
  • Our total liability to you in respect of all other losses arising under or in connection with our Agreement with you shall in no circumstances exceed £500 (five hundred pounds sterling).

Termination

You or we may terminate the Agreement at any time for whatever reason

High norms & contacting us

In the unlikely case that you need to make a complaint about the services provided by us, such complaint must be made to us in the first instance by contacting your account manager or emailing: complaint@simplysaveenergy.co.uk. You acknowledge that if you have any complaint about our services you will in the first instance follow our complaints procedure.

If you have a complaint about your energy supplier or supply contract in the first instance you should contact us and then if you are dissatisfied you should contact the Supplier directly and then, if necessary, the Energy Ombudsman. Your account manager may be able to assist you with this process.

If you are a Micro-Business*, Ofgem’s advice is that if you have any issue or complaint you should contact the Citizens Advice consumer service helpline.

Data Privacy & Call Recording

Your data will be retained as per the Data Retention Policy, but the data will be retained at a minimum for the period of any contract agreed through Simply Save Energy.

We will process your data under the Consent and Contract lawful basis under GDPR, and the data may be shared with third parties such as but not limited to, Energy Suppliers, Distribution Network Operators, and Meter Operators where relevant.

We will record all telephone calls with you for legitimate business purposes including so that we can improve the services we offer. All calls are encrypted for security and integrity purposes and to ensure that we comply with our requirements under data protection laws. Records of all calls will be kept by us for 7 years from the date of the particular call. Suppliers may retain your personal data in line with their own retention periods and privacy notices and you should ensure you familiarise yourself with any relevant documents or notices before agreeing to their terms and contracting with them.

Conflict of Interest

Occasionally situations may arise where we or one of our other clients have some form of interest in business transacted for you.

If this happens, or we become aware that our interests or those of one of our other clients conflict with your interest, we will obtain your consent before we carry out your instructions, and detail the steps we will take to ensure fair treatment.

Confidentiality

Simply Save Energy shall treat any information supplied to us in the strictest confidence and only relevant information will be passed by Simply Save Energy onto energy suppliers for the purposes requested.

The Contract is between you and us.  It is not intended to benefit any other person or third party in any way and no such party will be entitled to enforce any provision of the Contract.  The information disclosed by each party is confidential and may not be used or disclosed to any third party without the other’s prior written consent.  We will not engage with any third party and will not accept letters of authority issued by you to such third parties without our prior written consent, notwithstanding that each of us may disclose such confidential information as may be required by law, court order or any governmental or regulatory authority

Simply Save Energy may assign, novate or otherwise transfer part or all of the benefit of the agreement without prior written consent from you.

You shall not assign, novate or otherwise transfer the benefit or burden of the agreement without the prior written consent of Simply Save Energy, with such consent not to be unreasonable withheld.
